Terms of Service

1. Agreement
These Terms of Service govern your use of inbrekfuz.com and the Brekfuz knowledge intelligence platform (together, the "Service") operated by Brekfuz Private Limited ("the Company," "we," "us," or "our"), located at Prestige Tech Park, Marathahalli, Bengaluru, Karnataka 560103, India. By accessing the Service or by subscribing to a Brekfuz plan, you accept these Terms. If you are accepting these Terms on behalf of an organization, you represent that you have authority to bind that organization.
Nothing in these Terms limits any statutory rights you hold under the laws of your country of residence. These Terms are written in plain language; where legal interpretation is needed, the intent of the parties rather than the strict literal meaning governs.
2. Description of the Service
Brekfuz is an AI organizational knowledge graph platform. The Service connects to your team's existing tools (such as Slack, Confluence, Jira, GitHub, Notion, and Linear) using read-only access, maps knowledge ownership and task dependencies across your organization, scores single-person dependency risk, and generates onboarding paths and knowledge transfer recommendations for your operations and engineering teams.
The Service is designed for enterprise customers. Subscriptions are priced per organization, not per individual seat. The specific features available to your organization depend on the subscription tier you have selected.
3. Use of the Service
- You must be of legal age in your jurisdiction, or have parental or guardian consent, to use the Service. For enterprise subscriptions, the subscribing organization is responsible for ensuring that its authorized users meet this requirement.
- You agree not to use the Service for any unlawful purpose, to interfere with the operation of the Service or the systems it depends on, or to attempt unauthorized access to any part of the platform.
- You may not scrape, reverse-engineer, decompile, or copy the Service except to the extent expressly permitted by mandatory applicable law.
- Enterprise customers are responsible for ensuring that their use of the Service to process team member data complies with applicable employment law, privacy law (including the DPDP Act in India, to the extent applicable), and any internal policies governing the monitoring of employee activity.
- You agree to keep your account credentials confidential and to notify us promptly at [email protected] if you suspect unauthorized use of your account.
4. Intellectual Property
The Service, including its software, knowledge graph engine, dependency scoring algorithms, and all related technology, is owned by the Company or its licensors and is protected by intellectual property law. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose during your active subscription period. No other rights are granted; you may not use the Company's name, logos, or trademarks without prior written consent.
5. Customer Data
Data that your organization submits to or generates through the Service ("Customer Data") remains your property. You grant us a limited licence to use, store, process, and analyze Customer Data for the purpose of providing and improving the Service to you. We do not use the specific content of your organization's knowledge graph to train our AI models without explicit written consent from your organization's authorized administrator.
You are responsible for the accuracy and legality of Customer Data you submit. You warrant that submitting Customer Data to the Service does not infringe any third-party rights and that your organization has a lawful basis for sharing team member information with us for knowledge graph processing.
6. Disclaimers
The Service is provided on an "as is" and "as available" basis. We disclaim all warranties to the maximum extent permitted by applicable law, including warranties of merchantability, fitness for a particular purpose, and non-infringement. The knowledge graph outputs, dependency risk scores, and onboarding path recommendations generated by Brekfuz are analytical tools to assist your decision-making; they are not a substitute for your own judgment or for professional advice. Mandatory consumer or enterprise warranties applicable in your jurisdiction are not affected by this disclaimer.
7. Limitation of Liability
To the maximum extent permitted by applicable law, the Company's total liability for any claim arising from or related to the Service will not exceed the subscription fees paid by you in the 12 months immediately preceding the event giving rise to the claim, or INR 10,000, whichever is greater. The Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, or business interruption, even if advised of the possibility of such damages. Liability that cannot be excluded under mandatory law is not affected.
8. Indemnification
You agree to indemnify and hold harmless the Company, its officers, employees, and contractors from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your breach of these Terms, your violation of any third-party right, or your organization's failure to obtain proper authorization before submitting team member data.
9. Termination
We may suspend or terminate your access to the Service if you breach these Terms or if your subscription lapses. Upon termination, your licence to use the Service ends. We will retain your Customer Data for a reasonable period (as set out in our Privacy Policy or your subscription agreement) to allow you to retrieve it, after which we will delete it. Sections of these Terms that by their nature should survive termination, including Intellectual Property, Limitation of Liability, Indemnification, and Governing Law, will survive.
10. Governing Law and Jurisdiction
These Terms are governed by the laws of India. Any dispute arising from or related to these Terms or the Service will be subject to the non-exclusive jurisdiction of the competent courts in Bengaluru, Karnataka, India. This does not affect any mandatory consumer-protection or statutory rights you hold under the laws of your own country of residence. The parties agree to attempt to resolve disputes informally by contacting [email protected] before initiating formal proceedings.
11. Changes and Contact
We may update these Terms from time to time. Material changes will be posted with a new date at the top of this page. Continued use of the Service after the updated Terms take effect constitutes acceptance of the revised Terms. For significant changes, we will endeavor to notify active subscribers by email.
